  • According to well settled laws the best interests of the children controls the issue of a custodial parent moving to another state.
  • In a child custody modification context, the added difficulty in maintaining a beneficial relationship between a child and a custodial parent should not be the sole basis for restricting a custodial parent’s residence except where the benefits of a relationship cannot be substantially maintained if the child is moved away from the non-custodial parent. To hold otherwise would give the non-custodial parent the option of choosing the residence of a custodial parent.
